The Director shall provide the affected user an opportunity for a hearing whenever
the director proposes to revoke or to modify a pretreatment permit, to issue a unilateral
order, to disconnect a wastewater connection or to plug a sewer line, or to discontinue
water service pursuant to this division. The Director shall provide the opportunity
for a hearing prior to taking the action proposed by the Director unless an immediate
threat exists to the public health, safety or welfare; the environment; or the wastewater
system, in which event the Director may proceed with immediate action and provide
an opportunity for a hearing as soon as is practicable. Unless a user requests a hearing
within a reasonable time established by the Director, the user shall be deemed to
have waived the opportunity for a hearing.
