§ 25-9. Variations and exceptions.

  • The Commission may grant variations in the application of the sections of this chapter when:

    (1)

    A subdivider can show that, by reason of exceptional topographic conditions or other extraordinary or exceptional circumstances or conditions, the strict application of the sections of this chapter actually prohibit or unreasonably restrict the use of the property; or

    (2)

    The Commission is satisfied, upon the evidence presented to it, that strict adherence to the general regulations would result in substantial injustice or hardship.
