§ 22-144. Cessation generally.

  • (a)

    The membership of any person in the system shall cease upon:

    (1)

    Termination of service as an employee prior to becoming vested and upon the distribution of his or her member contribution account; or

    (2)

    Death.

    (b)

    For the purposes of this section, entering upon authorized leave of absence or into service in the Armed Forces of the United States shall not constitute termination of service as an employee unless the member does not reenter service as an eligible employee at the expiration of the period of authorized leave or within one year after honorable discharge from the Armed Forces, as the case may be in the case of military service ending before December 13, 1994, or within the time required by the Uniformed Services Employment and Reemployment Act of 1994 in the case of military service ending after December 12, 1994.
