§ 19-387. Exceptions to restrictions.

  • (a)

    Sections 19-385 and 19-386 and the offenses stated therein shall not be applicable in any circumstance in which:

    (1)

    The minor was accompanied by the minor's parent or legal guardian or other adult who has been granted custody of the minor by the minor's parent or legal guardian;

    (2)

    The minor was on a legitimate emergency errand at the direction of the minor's parent or legal guardian, without any detour or stop, or the minor was otherwise involved in a legitimate emergency circumstance;

    (3)

    The minor was engaged in an employment activity or going to or returning home from an employment activity, without detour or stop;

    (4)

    The minor was attending an activity sponsored by a City or State agency or body or a school or a religious or civic organization or was returning to the minor's place of residence therefrom, without detour or stop; or

    (5)

    The minor was within 25 feet of the minor's residence.

    (b)

    Sections 19-385(c) and 19-386(c) and the offenses stated therein shall not be applicable in any circumstance in which the proprietor, manager, or other person having charge or control of an establishment promptly notified the Department of Police that a minor was present on the premises of the establishment during curfew hours and the minor refused to leave.

    (c)

    Section 19-385 and the offenses stated therein shall not be applicable when the minor is:

    (1)

    In interstate travel through, or beginning or terminating in, the City;

    (2)

    Exercising First Amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech, and the right of assembly.
